Building Law in Tyrol

Building law as a matter of public law generally comprises all provisions that determine where and how construction activities may be carried out. This refers to the legal provisions of the building regulations and the spatial planning laws.

With regard to building law and the building regulations of the individual federal states in Austria, a uniform description of the most important building laws is challenging, as there is not just one, but nine different building regulations in Austria. The building industry, building law and building regulations are subject to state legislation. In 2008, however, building regulations were revised in most federal states with a view to harmonizing technical provisions (see OIB guidelines 1 to 6).

As specialized areas of public law, building and regional planning law are complex and require the expertise of proven specialists. Without extensive experience, it is difficult to understand the diverse legal regulations and framework conditions.

Mr. Gamsjäger is one of very few lawyers in Austria with many years of experience in public service at the Innsbruck district authority and the municipality of Telfs, where he himself issued hundreds of building permits and handled building negotiations. This specialist knowledge is confirmed by the completion of the administrative service examination in public law.
